About These Terms And Conditions
- In these Terms and Conditions "we" and "us" mean Roshell Australia Pty Limited of 10 Oxford Street, Paddington NSW, 2021 Australia, short name as ‘Roshell’ in below, and "you" means you the customer.
- These Terms and Conditions together with your Order constitute the entire Contract between us and you for the supply of Products. The Contract cannot be varied unless we agree to vary it in writing or by email.
Legal Capacity To Transact
- If you are under the age eighteen (18) years you cannot place orders with Roshell
- By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years.
- Should Roshell suffer any damage or other losses as a result of a transaction entered into by a minor, Roshell reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Roshell.
Placing Your Order
You may place an Order by click on the products you want and follow the shopping steps on the Roshell Web Site and clicking the "proceed to checkout" button.
When you place your Order, we will issue you with an Order Number. We will do this by email.
By placing an Order, you make an offer to us to purchase the Products you have selected based on these Terms and Conditions. Information contained on the Roshell website constitutes an invitation to treat. No information on our website constitutes or should be deemed as an offer by us to supply any Products; however Roshell will make every effort to supply Products to you. We will notify you that your order is being processed by sending you an Order Confirmation and tax invoice via email; however, we do not formally accept your offer until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing credit card or payment fraud. Auction Alliance and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion. We will confirm acceptance of your order when we send you an email confirming shipment of the goods you have ordered. If we cannot process or accept your Order after payment is received we will contact you by email or telephone.
Payment Methods And Processing
Roshell currently accepts Visa, MasterCard, direct deposit, cheque or money order only, our online merchant gateway is with Camtech Gateway.
Payment processing will not begin until we receive all the information we need.
Orders placed on a weekend or a Public holiday will not begin payment processing until the next business day.
Business days are Monday to Friday, excluding NSW Public holidays.
We process credit card payments after you click the "Submit My Order" button.
Where you pay by direct deposit, cheque or money order you must pay the price payable in Australian dollars as indicated on your Order Confirmation within 5 days from the date that you receive your Order Confirmation.
If a direct deposit payment or chque/money order is not received within 7 days from the date that you receive your Order Confirmation, Roshell reserves the right to cancel the transaction.
For credit card payments we will email a tax invoice to you with your Order Confirmation. Where you pay by direct deposit, cheque/money order a tax invoice will be sent to you via email after your payment has been confirmed. Your tax invoice is your proof of purchase.
Please Note:
- A security check may carried out for all credit card orders, and this will email to your registered email address, please confirm the questions ASAP to avoid delay of dispatching your order
- You may be required to provide further identification for additional security reference checks.
GST
Roshell sales include GST.
- Advertised prices are in Australian dollars. Typographical errors may occur, in which we shall make best endeavours to rectify, but are not responsible for.
- No information on this Website regarding any product or service available for purchase constitute a warranty or promise in respect to those products.
- Roshell always seeks to list Products with the highest quality and most competitive prices.
- Roshell reserves the right to change prices for Products displayed at Roshell website and stores at any time.
Roshell in its absolute discretion may from time to time provide discount Coupons to existing and/or new customers.
Coupons can only be used towards the payment of Products on our website.
Coupons can only be used in accordance with the Terms and Conditions under which the Coupons are issued. Any Terms and Conditions governing the use of a coupon will accompany that Coupon. Roshell will determine the content of Terms and Conditions governing Coupons in its absolute discretion.
Where a Coupon is used towards the payment of a Product (or Products):
1. There may be an left over after the Product purchase, and this the balance will be kept in the coupon for next purchase
2. In the event that you have insufficient (or no) coupons and/or gift cards on hand, you must thereafter pay any outstanding balance due on the Product by Credit cards, Direct deposit or Cheque/money order.

Supply Of Your Products
Subject to these Terms and Conditions, we will supply to you the Products indicated on your Order Confirmation.
When your Order items have been dispatched, we will email you to confirm shipment of each item including a tracking number for each item.
Delivery Of Your Products
· Delivery time takes up to 10 working days from the date your payment is received. Please note that direct deposit payments take 1-2 business days to process and cheques normally takes 2-3 days to reach us and another 1-2 days to clear.
· We use TNT for domestic road express, overnight first class and international express services,
· We currently use Australian post for PO Box address orders only, unless you specifically mark you want Australian post.
· Only one shipping method can be chosen per transaction. If you wish for some items to be standard and others via express, please complete two separate transactions.
· We aim to dispatch all orders within one business day of receiving them.
· Orders are dispatched from Sydney, New South Wales Australia.
Tracking
· Parcels are able to be tracked via TNT and Australian post website if ordered by express. You will be sent a dispatch confirmation email including tracking number and instructions once your parcel leaves our warehouse. · We encourage you to visit the "Your Account" section on our website to view the delivery status of your Products.
· If your parcel hasn't arrived please also check with your local TNT office or post office as it may be waiting for collection. Parcels are taken back to the nearest dispatch office if a signature cannot be obtained on delivery.
· The estimated delivery times are in business days (Monday through Friday) excluding Public holidays so we friendly recommend you use business address if you only available at work during business hours.
· Although every effort is made to ship your Order according to the estimated delivery times provided, estimated ship times may change due to changes in supply or circumstances beyond our control, we do not guarantee that we will deliver within this time frame. If your Product has not arrived after the estimated delivery time, please contact us here and we will lodge an investigation with TNT or Australian Post.
· Title and risk of loss to all Products will pass to you on delivery.
Returning a Product
- At Roshell we will pleased exchange for Credit notes for incorrect size, or change of mind within a 14 day period, as long as the items purchased haven’t been damaged or worn. This excludes all delivery costs.
- Please note we do not refund for change of mind purchases or incorrect sizes
- We do not exchange or refund on earrings
- We will refund, less delivery cost, or exchange by your choice in the event that the goods purchased are faulty within 30 days, provided the fault is not due to wear and tear, and is a manufacturing fault, this will be determined on the return of the item
- Please note when returning goods to Head office, the expense must be paid by customer however postage will be included for your Credit Note only if it is manufacturing faulty
- All returned goods must be received first before any exchanges can be processed
- A replacement for the same Product that you ordered will be shipped to you at our expense after we have received your returned faulty Product
- Please note that purchases made online cannot be returned to our Stores
- All credit notes are not to be used in conjunction with any other vouchers/discounts
- Please note we do not refund or exchange on sale goods unless it manufactory faulty
Requesting an Exchange, Credit or Assessment for a Refund.
Please attach the Original Invoice of purchase with a completed Assessment Form. Download Form
Post to Attention: Website Returns Unit.
- You agree to submit to the exclusive jurisdiction of the courts of Australia in the event of any dispute in relation to the use of this site.
- Roshell will not be held responsible for any damage to any products after delivery.
- Faulty products will be refunded back to you, if not replaceable or by your choice less postage, it will only be refunded back by original method used and back to original purchase credit card or bank account.
- Roshell will not able to refund to a third party account or different credit card.
Whilst Roshell employs the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers, Roshell will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.
General
By using this Website you show that you agree to all the above conditions.
Roshell reserves the right to change the Terms and Conditions of sale at any time.
These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales and shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.
